On Wednesday, July 13, the Occupational Safety and Health Administration announced it is delaying the effective date of the injury and illness recordkeeping regulation by three months. The rule was supposed to take effect August 10, but will be delayed until November 1. The agency’s announcement is likely in direct response to a lawsuit filed by the National Association of Manufacturers (NAM) challenging the rule, which also requested the court to prevent the rule from going into effect through a preliminary injunction motion. While this is some relief to manufacturers, the court will still have to rule on the motion and then proceed to the substance of the challenge.
