From Fred Waite and Kim Young, AWPA Counsel
The U.S. Department of Commerce (Commerce) and the U.S. International Trade Commission (ITC) are conducting the first sunset review of the antidumping (AD) orders on carbon and certain alloy steel wire rod from Belarus, Italy, Korea, Russia, South Africa, Spain, Turkey, Ukraine, the United Arab Emirates, and the United Kingdom and the countervailing duty (CVD) orders on carbon and certain alloy steel wire rod from Italy and Turkey.
Because no foreign producer has participated in these sunset reviews, both Commerce and the ITC are conducting expedited reviews. Expedited reviews usually result in affirmative determinations, which would continue these orders for a further period of five years.
In its sunset review of the AD orders, Commerce has already completed its expedited review and made an affirmative determination that revocation of these orders would be likely to lead to the continuation or recurrence of dumping. We expect that Commerce will make an affirmative determination in the sunset review of the CVD orders shortly.
The ITC has not yet set out the schedule for its expedited sunset review.
